1. Acceptance of Terms

By accessing or using FarmLists.org (the "Site") or any of its associated SMS services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Site.

These terms apply to all users of the Site, including farm owners who list their operations ("Farm Users") and members of the public who browse listings or subscribe to alerts ("Visitors").

2. Description of Service

FarmLists.org is a free directory that connects local farms with nearby consumers. The Site allows:

• Farm owners to create and maintain listings showing their location, products, and current availability
• Farm owners to update their listings via SMS photo messages
• Visitors to browse farm listings and search by location and product type
• Visitors to subscribe to SMS alerts when specific products become available near them

FarmLists.org does not facilitate sales transactions, take commissions, or act as an intermediary in any transaction between farms and consumers. We are a discovery and notification platform only.

3. Farm Listings & Accounts

Claiming a Listing

Farm listings may be pre-populated from public data sources. Farm owners may claim their listing by verifying ownership through the process described on the Site. By claiming a listing, you represent that you are authorized to manage that farm's public presence.

Accuracy

You are responsible for ensuring that all information in your listing — including name, address, contact details, and product availability — is accurate and kept current. FarmLists.org is not responsible for errors in listings submitted by farm owners.

Acceptable Use

Farm Users agree not to:

• Post false, misleading, or fraudulent information
• List products that are not legally available for sale
• Use the platform to harass, spam, or deceive consumers
• Attempt to manipulate search rankings or the platform's systems

4. SMS Messaging

Farm Owner SMS Updates

By providing a mobile phone number and claiming a farm listing, you consent to receive SMS messages from FarmLists.org related to your listing, including weekly update reminders and confirmation messages when your listing is updated. Message frequency varies. Message and data rates may apply.

Visitor SMS Alerts

By submitting your phone number to subscribe to product alerts, you consent to receive SMS notifications from FarmLists.org when farm products matching your preferences become available near you. Message frequency varies based on farm activity in your area. Message and data rates may apply.

Opt-Out

You may opt out of SMS messages at any time by replying STOP to any message. You may reply HELP for assistance. After opting out, you will receive one final confirmation message and no further messages will be sent.

5. Visitor Use

Visitors may browse the Site without creating an account. By using the Site, Visitors agree not to:

• Scrape, crawl, or systematically download Site content without permission
• Use the Site for any unlawful purpose
• Attempt to interfere with the Site's operation or security
• Misrepresent your identity or affiliation

6. User Content

By submitting content to FarmLists.org — including farm descriptions, product names, and photos — you grant FarmLists.org a non-exclusive, royalty-free license to display that content on the Site and in connection with the Site's services.

You represent that you own or have the right to submit all content you provide, and that doing so does not violate any third party's rights.

FarmLists.org reserves the right to remove any content that violates these Terms or that we determine, in our sole discretion, is inappropriate or harmful.

7. Accuracy of Listings

FarmLists.org makes no warranty regarding the accuracy, completeness, or timeliness of any farm listing, product availability, hours of operation, or other information displayed on the Site. Availability information is provided by farm owners and may not reflect current conditions.

We strongly recommend contacting a farm directly before making a trip to confirm availability and hours.

8. Disclaimers

THE SITE AND ALL CONTENT, SERVICES, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

FarmLists.org does not endorse any farm, product, or transaction that occurs as a result of using the Site. Any dealings between Visitors and Farm Users are solely between those parties.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY INDIANA LAW, FARMLISTS.ORG AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSSES ARISING FROM INACCURATE LISTING INFORMATION, FAILED TRIPS TO FARM LOCATIONS, OR RELIANCE ON PRODUCT AVAILABILITY DATA.

Our total liability to you for any claim arising from use of the Site shall not exceed $100.

10. Termination

FarmLists.org reserves the right to suspend or remove any listing or user access at any time, for any reason, including but not limited to violation of these Terms. Farm Users may request removal of their listing at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved in the courts of Vanderburgh County, Indiana.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
